Terms of service

Last updated 22 October 2026

These terms cover how we work with clients and how you can use this website.

01About these terms

These terms apply when you use fessburn.com or work with Fessburn, aleja Wyścigowa 14, 02-681 Warszawa, Poland, NIP 7812056448.

Every project also has a written proposal or contract with the scope, the price, and the timeline. If that document says something different from these terms, the proposal or contract applies.

02Scope and price

At the start of every project, we define the scope with you in writing and make sure both teams are aligned on it. The price is fixed for that scope. If you need more than we agreed on, we scope the extra work separately, so the original price and timeline don’t change.

The prices on our website are starting prices. The price you pay is the one in your written proposal.

03Payment

Projects under €5,000 are paid in full before work starts. For projects at €5,000 and above, you pay 50% at kickoff and 50% on delivery. Once we've agreed on the scope, the price is fixed.

Invoices are due within the period stated on the invoice. If a payment is late, we may pause the work and charge statutory interest for late payment under Polish law. Payments aren’t refundable once the work they cover has been delivered, unless we’ve agreed otherwise in writing.

04What we need from you

To keep the timeline, you agree to:

  • Name one person who can make decisions on your side
  • Send feedback within the review periods we agree on
  • Give us the content, files, and access we need for the project

You confirm that you have the right to give us the materials you share, like text, images, logos, and data, and that we can use them for your project. If feedback or materials arrive late, the timeline moves by the same amount.

05Who owns the work

Once you’ve paid in full, you own the designs, the code, and the documentation we made for your project. Until then, they stay ours.

Our own tools, templates, and code we wrote before your project stay ours, and you get a licence to use them as part of what we delivered. Third-party fonts, libraries, and services keep their own licences.

We’d like to show the project in our portfolio. If you’d rather we didn’t, tell us and we’ll leave it out.

06Confidentiality

We keep your confidential information confidential and only use it for your project. If you need a separate NDA, send it with your first email and we’ll sign it before you share any files.

07Third-party costs

Hosting, domains, app store accounts, paid APIs, and other third-party services aren’t included in our price unless the proposal says so. You pay those costs directly, or we pass them on at cost.

08Our responsibility

We do the work with care and to the standards agreed in the proposal. We can’t promise outcomes we don’t control, like regulatory approval, search rankings, or sales. Design and conformity decisions for regulated products stay with the manufacturer.

As far as the law allows, our total liability for a project is limited to the fees you paid us for that project, and we aren’t liable for lost profits or indirect losses.

09Ending a project

Either of us can end a project with written notice. You pay for the work done up to that point, and we hand over everything you’ve paid for.

10Using this website

You can browse and share fessburn.com freely. Please don’t copy our content, case studies, or images for your own commercial use without asking us first, and don’t try to break or overload the site.

11Law and disputes

Polish law applies to these terms. If we can’t settle a dispute by talking it through, it goes to the court that has jurisdiction over our registered office.

12Changes and contact

We may update these terms, and the date at the top of this page shows the latest version. The terms in place when you sign a proposal apply to that project. Questions go to hello@fessburn.com.
